The Rights And Obligations Of The Wife Over Husband In Islam

Marriage in islam is a legal contract between two individuals.Under islamic law , marriage is no longer viewed as a status but rather as a contract. The essential elements of the marriage contract are now an offer by the man, such as the payment of dowry and an acceptance by women. The presence of at least two witnesses are needed in the offer and acceptance.Marriage is an act of Sunnah in Islam. It is recommended strongly. The age of marriage is not determined depending the ready, finance, emotion of individual.

It is described in Alqur'an, Surah An-Nisa ayah 4 : And give a woman (upon marriage) their (bridal) gifts graciously. But if they give up willingly to you anything of it, then take it in satisfaction and ease.

The Alqur'an outlines some conditions of marriage as the following :
        • The marriage contract is between the guardian (wali) of the bride and the bridegroom.
        • A marriage should be conducted through a contract and a mandatory sum of wealth provided to the bride, which refers to the mahr.

The mahr may be separated into two parts :
        • A mu'qadamm (forepart presented mahr) : Mahr may also be paid in parts to the bride with an amount given by the groom to the bride at the signing of the marriage contract.
        • A mu'akhaar (delayed mahr) : Mahr portion is postponed to a date during the marriage.
Mahr is mentioned in Qur'an and hadith that there is no maximum limit to the amount of mahr paid by the groom, but its minimum is an amount that will be sufficient for the women to be able to survive independently if her husband dies or they divorce.

In the Qur'an , Allah states that If a husband wishes to divorce a wife and marry another that he may not take back any of the dowry, which was given no matter how large it was.

        Surah An-Nisa ayah 21 :

"And how could you take it while you have gone in unto each other and they (the women) have taken from you an solemn covenant."

A married woman has rights over the husband  as stated in the Qur'an, surah Al-baqarah ayat 228 :
" And due to the wife is similar to what is expected of them, according to what is reasonable."

Prophet Muhammad stated that You had your rights upon your wifes and they had their rights upon you.

The same Rights of Husband and Wife
        • The right to enjoy each other
        • The right to inherit from each other
        • The right of confirmation of the lineage of their children.

The rights of the wife over husband in Islam
        • The dowry is an obligation and a debt upon the husband until he pays it.There is no escaping it unless the wife gives up her right to it freely and willingly. As stated in the Qur'an, surah An-Nisa ayah 4 : " And give to the women (whom you marry) their mahr (obligatory bridal-money given by the husband to his wife at the time of marriage) with a good heart."
        • Support (nafaqah) is the most important right to feed and buy cloths to his wife.As stated in the qur'an surah An-Nisa ayah 34 : " Men are in charge of women because of what Allah has given to some more than others and because they support them their property."If a husband does not support his wife, she has no obligation to fulfill her obligations to him.
        • Kind and proper treatment is done by husband to his wife.Husband treats his wife by using kind speech, kind deeds, and beautiful manner. As stated in the Qur'an, surah An-Nisa ayah 19 : "..And consort with your wives in a goodly manner for, if you dislike them, it may be well that you dislike something which Allah makes a source of abundant good."
        • Marital relations is an obligation of husband.
        • A husband is not allowed to strike his wife in anyway that causes injury. As stated in the qur'an, surah An-Nisa ayah 34 : " But those (wives) from whom you fear arrogance-(first) advise them; (then if they persist), forsake them in bed; and (finally), strike them. But if they obey you (once more), seek no means against them.Indeed Allah, is ever Exalted and Grand."
        • Privacy is the right of the both spouses that the other cannot discuss their private moments with anyone else.
        • Justice between multiple wives is done by husband by providing house, food, clothing or all they need.It is described in the Qur'an, surah An-Nisa ayah  129 : " And you will not be able to effect justice between the women no mattter how hard you try.So do not incline (toward some) completely such that you leave (another) as if suspended. And if you reform and fear Allah, surely Allah is Forgiving and Merciful."
        • Husband must protect his wife's honor.Do not place her in the bad stuations .
        • Husband must respect his wife  and pay attention to her needs so she will respect and pay attention to him.
        • Husband must never divulge the secrets of household and those of married couple.
        • Husband must avoid jealousy excessively to his wife.
        • Husband must teach his wife about the religion and her obligations to the parents, husband, children, and neighbour. It is described in the Qur'an, surah At-Tahrim ayah 6 : "O you who have believed, protect yourselves and your families from a fire whose fuel is people and stones, over which are (appointed) angels, harsh, and severe; they do not disobey Allah in what He commands them but do what they are commanded."
        • The wife has right to live separate accomodation with her husband and children, if she does not like to share it with anyone like her in-law or relatives. She also has the right to refuse to live with her husband's father, mother, and siblings. This is the view of Hanafi, Shaafa'i and Hanbali fuqaha.

The obligation of wife is to safeguard the husband possessions and protect how wealth is spent. If the wife has wealth in her own capacity she is not obliged to spend it upon the husband or children, as she can own property and assets in her own right. The husband has no right for her property and assets except by her will. Both wife and husband are obliged to fulfill the other's sexual needs. Both of them are obliged to treat each other with kindness.Wife is obliged to obey her husband 's demands.

The Rights and Obligations Of The Husband Over Wife In Islam

Marriage is a legal bond and social contract between a man and a woman.Marriage in Islam requires acceptance (qubul) of the groom, and the bride, and the consent of the custodian (wali) of the bride. The contract of marriage in Islam is between wali of the bride and bridegroom.A male relative of the bride or her father is normally to be the custodian of the bride. The witness of marriage contract is either two adult muslim males or one adult muslim male and two adult muslim females in Sunni whereas Shia has two adult muslim males and permission from wali as the witness.

Both men and women have rights each other when they enter a marriage contract. The obligation of husband serves as protector and supporter of the family most of the time, from his means. The husband is financially responsible for the welfare and maintenance of his wives and children. He provides house, food, clothing and all they need.A pre-marital agreement of the financial expectation from the husband is in the mahr, given by him to the wife for her exclusive use, which is included as part of his financial responsibility. Both husband and wife are obliged to fulfill the other's sexual needs. Both are obliged to treat each other with kindness.

Prophet Muhammad stated that You had your rights upon your wifes and they had their rights upon you.

The same Rights of Husband and Wife
        • The right to enjoy each other
        • The right to inherit from each other
        • The right of confirmation of the lineage of their children.

The Rights of husband over wife in Islam
        • Being the head of the household. It is described in the qur'an, surah An-Nisa ayah 34 : " Men are in charge of women by (right of) what Allah has given one over the other and what they spend (for maintenance) from their wealth. So righteous women are devoutly obedient, guarding in (the husband's) absence what Allah would have them guarded.

Lying Is Greatest Sin, Haram And The Liar Afflicted With forgetful, Awful Smell , And Blackened Face

A lie is a statement that is known or intended by its source to be missleading, inaccurate, or false.Lying is the practice of communicating lies.A liar is a person who communicate a lie.The term carries a negative connotation, and depending on the context a person who communicates a lie may be subject to religion, social, legal or criminal sanction. In certain situations, lying is permitted, expected, or even encouraged.Because believing and acting on false information can have serious consequences.

There are Qur'anic verses to denounce lying :
        • Surah An-Nahl ayah 105
        • Surah Az-Zumar ayah 3
        • Surah Al-Imran ayah 61
        • Surah An-Nur ayah 8

Lying is one of the greatest sins.A tradition the Holy Prophet declares, "Beware I inform you regarding the greatest of the mortal sins : Associating anything with Allah, disobeying parents and lying."

The famous scholar, Shaykh Ansari writes in his book "Makasib Al-Muharrama" : "Common sense suggests lying is haram, All the revealed religions also say so; particularly Islam."

The Qur'an is explisit in this regard. The corpus of hadiths (opinion of the majority of jurists) verify this tennet and reason also sustain this assertion.

Undoubtedly lying is the worst of sin.It is obvious that the evils of lying are more dreadful that those of adultery.

Another tradition quoted from Prophet said, " When believer utters a lie without a valid excuse, he is cursed by seventy thousands Angels."
Such a stench emanates from his heart that it reaches the sky and because of this single lie, Allah writes for him a sin equivalent to that of committing seventy fornications.Such fornication that the least of which is fornication  with one mother.

Allah makes a liar afflicted with forgetfulness. He does not get an increase of  his sustenance.A liar has a bad or awful smell from his mouth.Angels move away from the liars.Lying is the ring of satan's finger.

There are some Qur'anic verses and traditions about Lying
        • Lying is transgression (Sural Al-baqarah ayah 197 and surah Al-Hujurat ayah 6).
        • Lying is an evil and a sin.
        • Lying means false word.
        • The liar is not believer.
Al-Qur'an, Surah An-Nahl ayah 105 : "Only they forge the lie, who do not believe the signs of Allah."
        • The liar is accursed.
Al-Qur'an, Surah An-Nur ayah 8 :".....the curse of Allah be on him if he is one of the liars."
        • The blackened face of the liar.
The Holy Prophet says,  " Beware of falsehood! Because falsehood blackens the face."
        • Sin of lying is worse than drinking wine.
        • The foul-smelling of the liar.
        • The Angels abhor the liars.
In a prophetic tradition said, "when a believer utters a lie, such a bad smell emanates from his mouth that even the Angels move away."
        • Lying is disbelief (kufr).
        • The stench of the liar's mouth reaches the sky.
        • The Angels of the sky curse the liars.
        • Lying destroys faith.
        • Lying or falsehood deprives from the liar from the taste of faith.
        • Lying causes animosity and hatred between people.
        • Lying is a sign of hypocrite.
        • Liar's advice is not paid heed by the Islamic Shari'a.
        • Lying is the most dreadful of the psychological disease.
        • Lying is an embellishment of satan's hand.
        • Lying is the worst profit from the trade.
        • Lying causes forgetfulness.
        • Lying is deprived of Salat al-Shab.
        • Falsehood deprives a liar from true guidance and cause him deviate.
Al-Qur'an, Sural Al-Jumu'a ayah 5 :" And Allah does not guide  the unjust people."

Every kinds of lie and every methods of untruth speaking are haram.Just as It is haram to speak a lie with tongue and is similar to write something false.Even it is haram to point a finger in expressing a lie.For instance, someone ask, " Have you prayed? He nods his head, actually he does not pray yet.It is a lie and haram.Similarly propagating the words of liar that they are aware and support a liar, it is haram and sin.

Zina : The Punishment Of Zina and Minor Zina

Zina is an Islamic law corncerning unlawful sexual relations between muslims who are not married to one another through a nikah.

Narrated by Umar Ibn Al-Khattab, Messenger of Allah (SAW) said, "Whenever a man is alone with woman shaytan makes a third." (Al-Tirmidhi 3118).

Zina includes extramarital sex  and premarital sex such as
        • Adultery : consensual sexual relations outside marriage.
        • Fornication : consensual sexual intercourse between two unmarried persons.
        • Homosexuality : consensual sexual relations between same-sex partners.

The Process of Accusation and Punishment of Zina
Islam requires evidence before a man or a woman can be punished for zina. There are
        • A confession by a Muslim of zina. However, the person has a right to retract his/ her confession; if confession is retracted , he/she is not punishable for zina ( barring the presence of four male Muslim witnesses), or
        • The woman is pregnant but not married, or
        • The testimony of four reliable Muslim adult male eyewitnesses, all of whom must have witnessed the penetration at the sama time.
        Qur'an, Surah Al-Nisa ayah 15
" If any of your women are guilty of lewdness, take the evidence of four reliable witnesses from amongst you against them; and if they testify, confine them to houses until death to claim them, or Allah ordain for them some (other) way."

Qur'an, Surah An-Nur ayah 11 and ayah 13 also reveal  the four witnesses requirement for zina that applies in the case of an accusation against  man or woman.

There is disagreement between Islamic Scholars on whether female eyewitnesses are acceptable witnesses in cases of zina.Islamic scholars state the requirement of four male eyewitnesses were to address zina in public.

For the crimes, Sharia considers two female witnesses equal the witnesses of one male.

In Sunni Fiqhs of Islam, female Muslim, child, and non Muslim witnesses of zina are not acceptable.

Any uninvolved Muslim witness or victim of non consensual sexsual intercourse, who accuses a Muslim of zina, but fails to produce four adults, pious male eyewitnesses before a Sharia Court, commits the crime of false accusation ( Qadhf ), punishable with eighty lashes in public.

Some Fiqhs (School of Islamic Jurisprudence) created the principle of shubha (doubt), wherein there would be no zina charges if a Muslim man claims he believed he was having sex with a woman he was married to or with a woman he owned as a slave.

All Sunni Schools of Jurisprudence agree that zina is to be punished with lethal stoning if the offender is a married Muslim (Muhsan). The punishnent for zina by a muhsan is a hundred lashes followed by stoning to death in public.Persons who are not muhsan (unmarried muslim) are punished for zina with one hundred lashes in public. But their life is spared.

Pregnancy of unmarried woman is regarded as evidence of zina.

Maliki School of Islamic Jurisprudence considers pregnancy as sufficient or authomatic service.

Other Sunni Schools of Jurisprudence rely on early Islamic Schoolars that state that a fetus can sleep and stop developing for 5 years in womb, and thus a woman who was previously married but now divorced may not have committed zina even if she delivers a baby years after her divorce. These alternate fiqhs of Sunni Islam consider pregnancy of never married woman as evidence of her committing crime of zina.

The Maliki do not require Ihsan for the imposition of stoning.

According to Hanafis, Homosexual intercourse can only be punished on the strength of tazir.Minimal proof for zina is still the testimony of four male eyewitnesses, even in the case of homosexual intercouse.

Accusation process and punishment vary from country to country.Prosecution of extramarital pregnancy as zina as well as prosecution of rape victims for the crime of zina, have been the source of wordwide controvercy in recent years.

        The Minor Zina

        Thera are minor zina :
        • The zina of the eyes is the lustful look.
        • The zina of ears is the listening to voluptuous songs or talks.
        • The zina of tongue is the licentious speech.
        • The zina of hands is the lustful grip.
        • The zina of feet is the walking to the place where he intends to commit zina.
Although there is no prescribed punishnent for the minor zina including the zina of eyes, the zina of ears, the zina of tongue, the zina of hands, and the zina of feet in the life of this world. If one dies without seeking taubah and repentance from Allah, he will be held severely countable for these acts of minor zina in The Presence of The Majestic Lord in the hereafter.

        • The first degree or rank is that of the common people. This rank shuns anything associated with God or the common people participate in taqwa by simply avoiding shirk.
        • The second degree or rank is the elect who shun sins.
        • The third degree or rank is that of the Prophets who avoid attributing acts to anyone other than God.Their fears come to them from Him and is (directed) to Him.The highest rank are those who distance themselves from everything that separates them from God, for one of the main goals in sufism is to get closer to God because being separated from God is equivalent to that of hell.

The tenth century sufi scholar, Al-Qushayri in his Epistle (Risala) writes about three parts of taqwa :
        • Full trust in God with respect to what has not been granted to Him.
        • Full satisfaction with what has been granted to Him.
        • Full patience with respect to what has eluded Him.

The Qur'an mentions a number of virtues that cultivate taqwa or that taqwa cultivates in a person :
        • Qur'an 2:283  : The keeping of trusts (Amana).
        • Qur'an 3: 76   : Faithfulness (Al-Wafa).
        • Qur'an 3:186  : Patience (Al-Sabr).
        • Qur'an 7: 96, Qur'an 10:63-64, Qur'an 39:10  :Taqwa to the good life (Hasanat) on this earth besides reward in the hereafter.
        • Qur'an  65:3   : Taqwa to material ease in this life even when the believer does not expect it.

According to Tafsir Ibn Kathir, the root meaning of taqwa is to avoid what one dislikes. It was reported that Umar bin Khattab asked Ubay Ibn Kaab about taqwa.Ubay said, "Have you ever walked on a path that has thorns on it?" Umar said, "Yes." Ubay asked, "What did you do then?" To which Umar replied, "I rolled up my sleeves and struggled." Ubay said," That is Taqwa, to protect oneself from sin through life's dangerous journey so that one can successfully complete the journey unscathed by sin.

        TAQWA OF THE PROPHETS

        • Taqwa is when Nooh (AS) called his people patiently to worship Allah for about 950 years.
        • Taqwa is when Ibrahim (AS) went to sacrifice his own son for the sake of Allah.
        • Taqwa is when Ismail (AS) accepted himself to be slaughtered for sake of Allah.
        • Taqwa is when Yousuf (AS) rejected the call of a beautiful woman to commit fornication.
        • Taqwa is when Moosa (AS) bravely called the dictator Firoun to worship Allah.
        • Taqwa is When Muhammad (PBUH) offered salah in the night though his past and future sins were forgiven.

        TAQWA OF THE PEOPLE

        People have taqwa are Muttaqun.

        • Who spend in path by carrying out Prayer (Salah), Fasting in Ramadan.
        •  Who control anger.
        • Who feel shame of mistakes and ask for forgiveness from Allah (SWT) from the mistakes.
        • The One who goes on this journey takes him with his supplies that will have him reach the holy land, and this reminds him that for the journey to his Lord, he must have with him provisions that will help him to arrive safely.Concerning this, Allah Says (interpretation of the meaning ) : "And take a provision (with you) for the journey, but the best provision is At-Taqwa (piety, righteousness."
